Privacy Policy

This privacy policy applies to the website at klarino.app and to the use of the Klarino application, and informs you about the collection, processing, and use of your personal data.

2. What data we collect

2.1 Website visitors

When you visit the website, technical data is automatically collected: IP address (anonymized), browser type, operating system, pages visited, and access times. This data is used to ensure operation of the site and to analyze website usage (legal basis: Art. 6(1)(f) GDPR / Art. 31(2)(c) nDSG).

2.2 Contact inquiries

When you contact us via the form or by email, we process your name, email address, and the content of your message to handle your inquiry (legal basis: Art. 6(1)(b) GDPR / Art. 31(2)(a) nDSG). Inquiries are deleted once processing is complete, and at the latest after 3 years.

2.3 User accounts (Klarino app)

When you register for and use the Klarino app, we process:

  • Account data: name, email address, password (encrypted), organization
  • Contract data: selected license, billing address, payment information (processed via Stripe)
  • Usage data: actions within the app, timestamps, error logs

This data is required to provide the service (legal basis: Art. 6(1)(b) GDPR / Art. 31(2)(a) nDSG). It is stored for the duration of the contractual relationship; billing data is retained in accordance with statutory retention obligations (10 years). Error logs are stored for as long as necessary for troubleshooting and to ensure system stability, and are then deleted automatically or manually. Providing account data is required to conclude and perform the user contract; without this information, we cannot set up a user account for you. No automated decision-making, including profiling, within the meaning of Art. 22 GDPR / Art. 21 nDSG that produces legal effects concerning you or similarly significantly affects you takes place.

2.4 Customer data within the app (data processing on behalf of a controller)

If, as a customer, you store personal data of third parties (e.g., contacts, employees) in Klarino, Byteful processes this data solely as a processor on your behalf. The data processing agreement (DPA) applies. For this data, you as the customer are the controller under data protection law.

3. AI Features

Klarino offers optional AI-powered features based on third-party AI models. If you use these features, certain data is transmitted to and processed by the relevant provider for this purpose. Customer data is never used by these providers for training purposes.

  • Anthropic PBC. Third-party provider of AI models used within our AI features, if used. This includes processing of user chat messages and requests, as well as business data required to fulfill the request. Processing is carried out solely to handle requests and return results. Anthropic PBC is based in San Francisco, United States.

For transfers to providers based in the USA, the safeguards listed in section 5 apply (EU-US Data Privacy Framework or EU Standard Contractual Clauses).

4. Cookies

The Klarino website and app use cookies. Technically necessary cookies (e.g., session management, CSRF protection) cannot be disabled, as they are required for operation. For analytics cookies, we obtain your consent (legal basis: Art. 6(1)(a) GDPR).

You can delete or restrict cookies at any time in your browser settings.

5. Third-party providers and transfers abroad

We use the following third-party providers to operate our website and app. Where personal data is transferred outside Switzerland or the EU/EEA, we ensure an adequate level of protection through the safeguards listed below.

  • Hosting: Hetzner Online GmbH, hosting of our infrastructure. Location: EU (Germany). No third-country transfer.
  • Payment processing: Stripe Payments UK Ltd and its affiliates, processing of payment and billing data. Location: UK, EU (Ireland), USA, and other countries (see Stripe's current sub-processor list). Safeguards: UK adequacy decision, EU Standard Contractual Clauses, EU-US Data Privacy Framework.
  • Website analytics: Google Ireland Limited / Google LLC (Google Analytics, Google Tag Manager), analysis of website usage. Location: EU / USA. Safeguards: EU-US Data Privacy Framework, EU Standard Contractual Clauses.
  • Error monitoring: Functional Software, Inc. (Sentry), collection and analysis of error logs to identify and fix technical issues. Location: EU. Safeguards: EU Standard Contractual Clauses.

For transfers from Switzerland, we rely on safeguards recognized by the FDPIC (Art. 16 nDSG).

Note on Google Analytics: We use Google Analytics exclusively with IP anonymization enabled.

6. Data security

We protect your data through appropriate technical and organizational measures pursuant to Art. 32 GDPR / Art. 8 nDSG, in particular through:

  • Encrypted data transmission (TLS/HTTPS)
  • Encryption of stored data
  • Access controls and multi-factor authentication
  • Regular backups and data security testing

7. Your rights

You have the right to:

  • Access to the data we process about you (Art. 15 GDPR / Art. 25 nDSG)
  • Rectification of inaccurate data (Art. 16 GDPR)
  • Erasure of your data, provided no retention obligations apply (Art. 17 GDPR)
  • Restriction of processing (Art. 18 GDPR)
  • Data portability in a machine-readable format (Art. 20 GDPR)
  • Object to processing based on legitimate interests (Art. 21 GDPR)
  • Withdraw consent given at any time, with effect for the future
  • Lodge a complaint with a supervisory authority, in particular the Swiss Federal Data Protection and Information Commissioner (FDPIC) for Switzerland or the competent supervisory authority in the EU/EEA, if you believe that the processing of your personal data violates applicable data protection law

8. Changes

We reserve the right to amend this privacy policy at any time. In the event of material changes, we will inform registered users by email. The current version is available on the Klarino website (klarino.app).
